Builder Booked for Allegedly Concealing Illegal Construction, Cheating Flat Buyer in Chakan
Developer allegedly sold an unauthorised flat as a legally approved property; complainant claims financial loss of ₹12.73 lakh
Pimpri Chinchwad : A case of cheating has been registered against a builder in Chakan for allegedly concealing information about the unauthorised construction of a residential flat and selling it to a buyer by falsely portraying it as a legally approved property. According to the complaint, the buyer suffered a financial loss of ₹12,73,742 in the transaction.
The complaint was lodged by Nivrutti Bhausaheb Thosar (37), a resident of Ghatkopar, Mumbai, at the Chakan South Police Station. Based on his complaint, police have registered a case against Bajrang Haribhau Naikare (43), a resident of Nanekarwadi in Khed taluka, Pune district.
According to police, the accused had sold Flat No. 3 in the Aryanvish Building, part of the Aryan Vig Promoters and Developers project, to the complainant. The complaint alleges that the accused was aware that the flat had been recorded as unauthorised in the Gram Panchayat records but deliberately concealed this information from the buyer.
The builder allegedly represented the flat as a legally constructed property and accepted a total amount of ₹19,00,500 from the complainant and his father through bank transactions made on different occasions.
Subsequently, on June 9, 2017, the sale deed for the flat was registered in the complainant’s name at the Joint Sub-Registrar Office in Chakan under document number 4636/2017.
However, the complainant later learnt from the Gram Panchayat that the construction of the flat was unauthorised. He alleged that the builder had deliberately withheld this crucial information and misrepresented the legal status of the property to induce the purchase, thereby causing him financial loss.
Following the complaint, Chakan South Police registered a case on October 31, 2026, under Section 318(4) of the Bharatiya Nyaya Sanhita (BNS), which deals with cheating involving dishonest inducement to deliver property.
Assistant Police Inspector Dhaygude is conducting further investigation. Police are looking into the allegations and the circumstances surrounding the sale and registration of the flat.
