{"id":2351,"date":"2026-07-18T17:42:29","date_gmt":"2026-07-18T12:12:29","guid":{"rendered":"https:\/\/theleadernews.in\/?p=2351"},"modified":"2026-07-18T17:42:30","modified_gmt":"2026-07-18T12:12:30","slug":"maharera-cracks-down-on-builder-over-delay-in-conveyance-deed-orders-registration-within-30-days","status":"publish","type":"post","link":"https:\/\/theleadernews.in\/?p=2351","title":{"rendered":"MahaRERA Cracks Down on Builder Over Delay in Conveyance Deed; Orders Registration Within 30 Days"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Pimpri :<\/strong> In a significant ruling safeguarding the rights of housing societies, the Maharashtra Real Estate Regulatory Authority (MahaRERA) has directed a builder to complete the conveyance deed process after finding that merely sending a draft agreement to the society does not fulfil its legal obligation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The order was passed in response to a complaint filed by Nirman Milestone Co-operative Housing Society at Kiwale through Advocate Ajit Borade. MahaRERA Member Mahesh Pathak issued the order on July 15, 2026, directing Nirman Venture to finalise the draft conveyance deed within 30 days through mutual consultation with the society and complete the registration in the society&#8217;s name within the following 30 days.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Builder Cannot Evade Statutory Responsibility<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Referring to Section 17 of the Real Estate (Regulation and Development) Act (RERA), MahaRERA observed that executing the conveyance deed in favour of the housing society is a statutory responsibility of the promoter. Merely forwarding a draft conveyance deed does not amount to compliance with the law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The authority further clarified that any dispute between the builder and the landowner cannot be used as a justification to delay or avoid the builder&#8217;s legal obligations towards the housing society.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Common Areas Must Be Transferred as Per Approved Plans<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The society had objected to the draft conveyance deed submitted by the builder, alleging that the land area mentioned in the draft was smaller than the area approved in the sanctioned plans and project registration documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Accepting the society&#8217;s contention, MahaRERA directed the developer to transfer all common areas, internal roads, and undivided rights to the society strictly in accordance with the approved layout plans and the project registration records.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The authority also instructed the builder to hand over all documents required for the conveyance process to the society.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Warning of Penal Action<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">MahaRERA warned that failure to comply with the order would invite action under <strong>Section 63 of the RERA Act<\/strong>, which empowers the authority to initiate penal proceedings against the defaulting promoter.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Advocate Calls Order a Landmark for Housing Societies<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Advocate Ajit Borade, counsel for the complainant society, welcomed the decision, saying, &#8220;MahaRERA has once again made it clear that executing the conveyance deed is the builder&#8217;s legal obligation. A builder cannot escape this responsibility by merely sending a draft deed or citing disputes with the landowner. This order is a significant step towards protecting the property rights of housing societies and will serve as an important precedent for societies across Maharashtra.
